1. Agreement to Terms

By accessing nexmoq.com or installing and using the Nex MOQ Shopify app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our services.

"We," "us," and "our" refer to Nex App Studio, the company behind Nex MOQ. "You" and "your" refer to you as a user of our website or app.

2. Service Description

Nex MOQ is a Shopify app that allows merchants to set minimum and maximum order quantity limits, minimum order amount thresholds, and checkout validation rules. The app runs on Shopify Functions and integrates natively with the Shopify checkout.

We provide the app on a subscription basis through the Shopify App Store. Features, pricing, and plan availability are described on our Pricing page and may change over time.

3. Eligibility

To use Nex MOQ, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction)
  • Have a valid Shopify store
  • Have the authority to bind your business to these Terms

4. Account and Access

Access to the Nex MOQ app is managed through your Shopify account. You are responsible for maintaining the security of your Shopify credentials and for all activity that occurs under your account.

5. Acceptable Use

You agree not to:

  • Use the app for any unlawful purpose or in violation of Shopify's terms
  • Attempt to reverse-engineer, decompile, or extract the source code of the app
  • Interfere with or disrupt the app's infrastructure or other users' access
  • Use automated tools to scrape, crawl, or extract data from our website or app beyond normal use
  • Resell, sublicense, or redistribute the app without our written permission

6. Billing and Subscriptions

Nex MOQ subscriptions are billed through the Shopify App Store. Billing terms, including free trial periods and recurring charges, are governed by Shopify's billing policies in addition to our own pricing terms.

You may cancel your subscription at any time by uninstalling the app from your Shopify admin. Cancellation takes effect at the end of your current billing cycle.

7. Intellectual Property

All content, code, designs, and trademarks associated with Nex MOQ and the nexmoq.com website are the property of Nex App Studio. You may not copy, modify, or distribute our materials without written permission.

Your store data remains your property. We claim no ownership over the content, products, or configurations you create using our app.

8. Limitation of Liability

To the maximum extent permitted by law, Nex App Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Nex MOQ. This includes, but is not limited to:

  • Lost revenue or profits
  • Lost data
  • Business interruption
  • Checkout errors or order processing issues

Our total liability for any claim related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Disclaimer of Warranties

Nex MOQ is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the app will be uninterrupted, error-free, or compatible with all Shopify themes or configurations.

We make reasonable efforts to ensure the app works correctly with Shopify's checkout system, but we cannot guarantee compatibility with every third-party app, custom theme, or Shopify update.

10. Indemnification

You agree to indemnify and hold harmless Nex App Studio from any claims, damages, or expenses arising from your use of the app, your violation of these Terms, or your violation of any third party's rights.

11. Termination

We may suspend or terminate your access to the app if you violate these Terms or if we are required to do so by law. You may terminate your use at any time by uninstalling the app.

Upon termination, your right to use the app ceases immediately. Sections that by their nature should survive termination (including liability limitations, indemnification, and dispute resolution) will remain in effect.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of the app after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the service will be resolved through good-faith negotiation first, and if necessary, through binding arbitration or the courts of competent jurisdiction.
